Category policies and requirements

YuHu Creates limits the addition of new Vendors for certain categories to ensure a high level of quality. The requirements for selling in the Jewellery category are listed below. While our still apply, please note the additional requirements for this category.

Note: YuHu Creates may remove approval to sell in the category for failure to meet these requirements.

Vendor requirements

  • You must have a Valid Subscription to the Business Plus package.
  • Inventory greater than ten products in this category.
  • Return delivery address in the local country or offer free delivery.
  • Able to provide local language support for Customer Service in the marketplace into which the product will be sold.
  • Must provide acceptable documentation (e.g. valid invoices) and other information we request about the products you intend to sell.

You should refer to current UK Brexit guidance about your products (see below) to learn more about changes that may affect you following the end of the transition period.

Product requirements

I. EU Requirements

  • All products must be new. No used products are allowed in the Jewellery category. We do not allow the sale of pre-owned vintage or antique jewellery.
  • All unbranded jewellery products must be listed on separate Vendor-created detail pages. Matching to existing selections other than branded designer jewellery and jewellery accessories that include manufacturer UPC codes is not allowed in the Jewellery category. All products must be intended for sale in EU and comply with all applicable EU laws and regulations of the (as well as any applicable local laws).
  • Each product must have one of the following:
    • A valid Barcode registered and associated with the product, or
    • Barcode exemption, or
    • Be enrolled into the Brand Registry Program
  • Note: If the manufacturer of your product does not issue EANs or UPCs, you can contact Vendor Support to request a UPC Exemption. If you are the brand owner, you can apply for the YuHu Creates Brand Registry to obtain GCIDs unique to your products.
  • All products need to comply with the EU REACH Regulation.
  • If you intend to list branded products, YuHu Creates reserves the right to ask for proof of purchase of those products from the Vendor during the evaluation of the application in order to guarantee the quality of the product. If the Vendor cannot provide documentary proof of purchase to Vendor Support, YuHu Creates reserves the right to decline the application request.
  • Local hallmark legislation for precious metals applies and must be respected for selling Jewellery in the EU.
  • If you wish to sell jewellery in Germany and France, please note that hallmarks are required for all precious metal items, except for those containing less than 30g silver or less than 3g gold.

You will find a comprehensive list of all YuHu Creates’s image standards specific to your product category in the corresponding style guide. Please read the Jewellery Style Guide carefully as images you upload for the Jewelry category must conform to these standards.

II. UK Requirements

Product Requirements

  • All products must be new. No used products are allowed in the Jewellery category. We do not allow the sale of pre-owned vintage or antique jewellery.
  • All unbranded jewellery products must be listed on separate Vendor-created detail pages. Matching to existing selections other than branded designer jewellery and jewellery accessories that include manufacturer UPC codes is not allowed in the Jewellery category.
  • All products must be intended for sale in the UK and comply with:
    • all EU laws and regulations (including applicable marks and labels) as well as national UK requirements if first made available in the UK on or before 31 December 2020; or
    • UK laws and regulations (only), if first made available in Great Britain (England, Scotland and Wales, “GB”) after 31 December 2020; or
    • EU laws and regulations under the Northern Ireland Protocol if first made available in Northern Ireland (“NI”) after 31 December 2020 (see “Northern Ireland” section below).
  •  
  • Products that are first made available in the EU or UK on or before 31 December 2020 can continue to circulate until they reach their end user and do not need to comply with the changes that take effect from 1 January 2021. You can retain evidence of when products were first made available in the UK or EU by keeping documents including contracts of sale, invoices and documents concerning the shipping of goods for distribution.
  • Each product must have one of the following:
    • A valid Barcode that is registered and associated with the product, or
    • Barcode exemption, or
    • Be enrolled in the Brand Registry Programme
  • Note: If the manufacturer of your product does not issue EANs or UPCs, you can contact Vendor Support to request a UPC Exemption. If you are the brand owner, you can apply for the YuHu Creates Brand Registry to obtain GCIDs that are unique to your products.
  • All products first made available in the UK or EU on or before 31 December 2020 need to comply with the EU REACH Regulation. Products first made available in GB after 31 December 2020 will need to comply with an amended version of the REACH Regulation which will apply to chemicals as a result of the REACH etc. (Amendment etc.) (EU Exit) Regulations 2019/758. Products first made available in NI after 31 December 2020 will continue to need to comply with the EU REACH Regulation under the Northern Ireland Protocol (see “Northern Ireland” section below).
  • If you intend to list branded products, YuHu Creates reserves the right to ask for proof of purchase of those products from the Vendor during the evaluation of the application in order to guarantee the quality of the product. If the Vendor cannot provide documentary proof of purchase to Vendor Support, YuHu Creates reserves the right to decline the application request.
  • Local hallmark legislation for precious metals applies and must be respected in order to sell Jewellery in the UK. Products carrying a certain weight of precious metals require hallmarks before they can be sold in the UK: More than 1g for gold, 7.78g for silver, 0.5g for platinum and 1g for palladium. For more information, visit www.assayoffice.co.uk/our-services. You may be requested to produce hallmark certification from the Assay Office during the application process. If you cannot provide the requested certificate, YuHu Creates reserves the right to decline the application request.

Northern Ireland

Note that different rules will apply in NI from 1 January 2021 as a result of the Northern Ireland Protocol. In particular:

  • You should ensure that products meet all applicable EU requirements including REACH.
  • You should ensure that ECHA has been notified, as required by EU REACH and CLP.
  • Northern Irish businesses that are currently downstream users or distributors may have obligations in relation to chemicals traded from GB to NI.
  • Northern Irish businesses may also have obligations to notify GB authorities if placing highly regulated goods in GB.
  • “Qualifying Northern Ireland goods” will be able to be sold in GB under unfettered access rights. The UK Government is issuing guidance on how this will work.

BREXIT: UK Government Guidance

The UK Government has released guidance on selling products in GB and NI after Brexit. This guidance provides information for manufacturers, importers and distributors regarding compliance requirements from 1 January 2021, including on:

  • whether you need to change your conformity assessment;
  • when and how to use the UKCA mark;
  • requirements for technical documentation and a specific Declaration of Conformity for products sold in GB;
  • appointing an authorised representative or responsible person in the UK;
  • whether your legal responsibilities will change as a result of Brexit;
  • whether you need to provide GB importer information, and methods for doing this (including transitional arrangements until the end of 2022);
  • how to deal with existing stock;
  • what documentary evidence is required to show that products have been placed in the UK or EU before the end of the Transition Period; and
  • specific rules for selling products in NI

We encourage you to review this guidance (linked below), alongside any other specific UK Government guidance that applies to your product. You should consult your legal counsel if you have questions about how the laws and regulations apply to your products from 1 January 2021.
